Description of Practice Areas

Attorneys in the New York office are actively involved in the following practice areas:

Construction

Schnader's construction group in New York enjoys a well-established reputation for developing innovative legal solutions to challenging construction problems. As the lawyer-ranking organization Chambers USA has observed, "This compact but hard-hitting team of five is renowned for its expert handling of high-profile construction litigation cases." Our construction lawyers bring years of experience and familiarity to the issues of construction law and litigation, whether those issues arise during the pre-construction drafting of agreements, or after suit or arbitration is filed. The construction group's practice encompasses an array of clients, including owners, general and specialty contractors, sureties, and insurers. Our lawyers have been involved in virtually every conceivable type of construction project from hospitals, museums, office buildings and courthouses to process and treatment plants, dams, bridges, tunnels, transportation and marine facilities, and power plants.

Litigation and Arbitration

Our litigators handle a broad spectrum of cases – including commercial transactions, torts, employment, aviation, antitrust, franchise, product liability and insurance coverage – in federal and state courts throughout the State of New York and the greater metropolitan area. Our New York attorneys are trained and skilled in mediation and arbitration techniques and regularly litigate private disputes before various arbitral and self-regulatory organizations, including the American Arbitration Association, the International Chamber of Commerce and the National Association of Securities Dealers, Inc.

Employment

Our employment lawyers represent and counsel employers and senior executives on matters relating to all phases of the employer-employee relationship. Our New York attorneys litigate and arbitrate termination, discrimination and employment law issues. They regularly appear on behalf of clients before the Equal Employment Opportunity Commission and the New York State Division of Human Rights. They assist and advise clients in the preparation of employment handbooks, policies and manuals and are regularly called upon by employers to conduct internal investigations and compliance checkups.

Corporate and Securities

Schnader's corporate lawyers in New York represent public and private companies in acquisitions, divestitures, mergers, consolidations, and equity and debt offerings. They regularly advise clients on corporate governance and business structuring issues under the New York Business Corporation Law, the New York Limited Liability Company Law, the New York Not-for-Profit Corporation Law, the Delaware General Corporation Law and the Delaware Limited Liability Company Act. They counsel public companies on reporting and compliance issues under the federal securities laws. As noted below, our lawyers advise a number of companies that are headquartered outside the United States.

Trusts and Estates

Our trusts and estates lawyers provide estate planning as well as estate and trust administration services to clients. They advise clients on gifts and bequests, educational trusts, living trusts, irrevocable insurance trusts, offshore asset protection trusts, qualified personal residence trusts, and grantor retained annuity and unitrusts. Our attorneys create and assist in the implementation of estate freezing devices such as family limited partnerships and limited liability companies. They counsel clients on the creation of private foundations, charitable remainder and charitable lead trusts. They also have experience in contested probate, contested accounting and other litigated estate and trust matters.

International

Our attorneys have experience in counseling and litigating on behalf of foreign clients doing business in the United States and have worked extensively on cross-border joint ventures, strategic alliances and investments involving the laws of multiple jurisdictions. Italian, French, German and Spanish are spoken fluently by several of our lawyers.

Intellectual Property

The New York office handles a wide range of matters, for clients domestic and international, in the areas of copyright, trademark, trade secret and unfair competition. Some of our cases in the trade secret area secured unprecedented relief and are recognized landmarks. Our attorneys routinely work in conjunction with our IP lawyers in other offices, including Philadelphia, PA; Wilmington, DE; San Francisco, CA; and Washington D.C. The office has recently expanded its capabilities in the intellectual property area to include complex patent litigation.
