Bruce Merenstein authored a post for The Legal Intelligencer Blog published on August 25 examining the 3rd U.S. Circuit Court of Appeals' decision in Briscoe v. Klaus, emphasizing that district courts are affirmed on appeal much more often than they are reversed, but on occasion, such as in the Briscoe case, they not only get it wrong, they get it really, really wrong.
