Barkasy Quoted in “Bankruptcy Judge Shortage Could ‘Cripple’ Delaware”

Creditors’ Rights and Business Restructuring Chair Richard A. Barkasy was quoted in the article, “Bankruptcy judge shortage could ‘cripple’ Delaware,” published by The News Journal on April 10, 2017. The article discusses how Congress created 27 temporary judgeships across the U.S., five of which were in Delaware, in 2005 as bankruptcy filings skyrocketed. Those positions are set to lapse in May and cannot be filled without Congressional action.

“Because of the number of Chapter 11 cases filed in Delaware, it is important that the Delaware Bankruptcy bench is full and strong,” Mr. Barkasy said. “If that were to change, it would have a detrimental impact on the bankruptcy system, not just in Delaware, but nationwide because Delaware handles so many large Chapter 11 cases.”
