Barnes Foundation Move Likely To Be Affirmed on Appeal
On January 12, 2005 by Schnader in AppellateSchnader Chairman Ralph G. Wellington was quoted as being “very comfortable” that Judge Stanley Ott’s decision regarding the move of the Barnes Foundation to Center City Philadelphia “will be affirmed on any appeal.”
According to The Philadelphia Inquirer article, “Barnes Move To Be Fought,” Jay Raymond, a Barnes Foundation art student, is fighting Judge Ott’s ruling that allows the Foundation to move from Lower Merion Township to Philadelphia, and the student’s attorney has filed an appeal.
“We also do not believe that Raymond, or the three students who were never actual parties in the case, have a legal right to appeal, and the court will have to decide that first,” said Ralph.
