Barrie and Bressler Write on Landlord-Tenant Issues

Barry Bressler and Michael Barrie wrote an article titled “A Reminder: Residential Security Deposits Under Pennsylvania Law,” published in Thomson-West’s Quinlan’s Pennsylvania Landlord-Tenant Reporter (Vol. 3, No. 3, March 2008).

Pennsylvania’s Landlord Tenant Act of 1951 contains clear provisions regarding maintaining and returning security deposits under residential leases. The article discusses the following policies of a residential leasing contract: the amount that a tenant is required to pay the landlord as a security deposit; landlord requirements for maintaining security deposits received from tenants; policies for returning a security deposit to a tenant upon termination of the lease or upon surrender and acceptance of the leasehold premises; and, liability issues faced by landlords who are not in possession of their leased premises.
