On October 16, 2012 by Schnader in AppellateA team of Schnader attorneys secured an important appellate victory for a Delaware inmate seeking redress for injuries caused by a now-deceased Delaware prison guard. The Third Circuit’s precedential decision clarifies the law under Rule 25 of the Rules of Civil Procedure regarding substitution of parties upon the death of a defendant. In particular, it discusses often-overlooked service requirements. The team, led by Thomas W. Hazlett and Carl A. Solano, was assisted by Bruce P. Merenstein, Stephen A.
