Schnader Successfully Defends a Builder’s Storm Water Management System Against a Multi-Million Dollar ClaimOn March 20, 2009 by Schnader in Litigation
Schnader achieved a significant litigation victory for Firm client Lennar. The action involved a $2,250,000 claim for damages arising out of the design of storm water management facilities for Goddard Farm, a 43-home subdivision in Baltimore County, Maryland.
The plaintiff, Michael Jurkiewicz, owns a large tract of property immediately to the west of Goddard Farm. Mr. Jurkiewicz asserted that Lennar was inappropriately discharging storm water onto his property which had, as a result, devalued his property and destroyed the development potential for the northern portion of his property.
Gordon Woodward and Mollie Finnan, both resident in Schnader’s Washington, DC office, tried the case on behalf of the Firm. Ultimately, the jury found in favor of Lennar on all counts. On March 10, 2009, the court denied the plaintiff’s request for injunctive relief and ruled in favor of Lennar on all post-trial motions, including one for a new trial based on alleged juror misconduct.
