Timothy K. Lewis Helps Develop Clause to Ensure Diversity in Alternative Dispute Resolution

On April 3, 2020 by Schnader in Alternative Dispute Resolution

The International Institute for Conflict Prevention and Resolution (CPR) has released a new clause that will be made available to parties that want to pre-commit to having diverse panels for Alternative Dispute Resolution. Schnader’s Hon. Timothy K. Lewis is co-chair of the Diversity in ADR Task Force for the CPR, which developed the clause that can be applied toward future disputes to be resolved by arbitration.

The clause states in part:

“The parties agree that however the arbitrators are designated or selected, at least one member of any tribunal of three arbitrators shall be a member of a diverse group, such as women, persons of color, members of the LGBTQ community, disabled persons, or as otherwise agreed to by the parties to this Agreement at any time prior to appointment of the tribunal.”

Timothy K. Lewis is a former federal appeals judge and is co-chair of Schnader’s ADR Practice Group. He serves as a mediator, arbitrator, settlement counselor, and trial and appellate practitioner.

CPR is an independent nonprofit organization that helps prevent and resolve legal conflict more effectively and efficiently.
