UPDATE: New York City Delays Enforcement of Law Restricting Employer Use of Automated Employment Tools to April 15, 2023

As we noted in our recent Client Alert, New York City’s law (Local Law 144 of 2021) requiring employers to conduct a bias audit on an automated employment decision tool before using that tool, among other requirements, takes effect on January 1, 2023. The New York City Department of Consumer and Worker Protection (DCWP) is preparing rules for the law and planning to hold another public hearing because of the high volume of public comments it received in response to its issuance of proposed rules regarding this law. Although the law still takes effect on January 1, 2023, DCWP has delayed enforcement of the law until April 15, 2023.

The hearing for these rules will be held at 11:00am on Monday, January 23.
