Partner Denny Shupe discussed, “Flying Over Conflict Zones: The Legacy of Malaysian Airlines Flight 17” at the 8th Annual McGill Conference on International Aviation Liability and Insurance on Friday, April 17, 2015. Panelists explored potential legal issues stemming from the aircraft’s 2014 crash, including:

  • Who are the potential defendants–the airlines, aircraft manufacturers, air navigation service providers, or the state?
  • What are the potential liability risks to ICAO, IATA, airlines and governments of participating in or providing a clearinghouse of threat information?
  • What issues arise when some airlines avoid flight paths into conflict zones, and others do not?
  • What are the insurance implications of AVN 67B and C?
