Schnader Attorneys Present “Does Criminalization of Aviation Accidents Impact Safety?”

On August 9, 2012 by Schnader

Schnader partners J. Denny Shupe and Robert J. Williams presented “Does Criminalization of Aviation Accidents Impact Safety?” on Thursday, August 9, 2012 at the Pittsburgh Area Aviation Safety Day. Mr. Shupe and Mr. Williams addressed national and international experience and trends related to the criminalization of unintentional, negligent conduct in aviation; how the criminalization of aviation and the existence of parallel criminal and safety investigations can negatively affect the proper investigation of accidents and the prompt determination of accident causation; and how criminalization of aviation can impede “just culture” safety occurrence reporting and other voluntary information sharing that helps prevent aviation accidents. The presentation argued that criminalization of aviation accidents does not deter behavior or errors that typically lead to accidents, but instead negatively restricts the candid and open determination and exchange of information that is necessary to enhance safety and to prevent future accidents.
