Schnader’s Schaerf, Loscalzo and Reimann Discuss What Every In-House Lawyer Should Know About Antitrust When Dealing With Distribution Issues

The law of “vertical restraints,” how businesses in distribution chains deal with each other, has been ever-changing since the mid-1970s. This program addressed the dos and don’ts of dealing with your distribution network and served – more generally – as an antitrust primer for in-house counsel. Topics that were covered included concepts of geographic and product market definition, market share and market power, and per se versus Rule of Reason judgment of “restraints of trade.”

Partners Theresa E. Loscalzo and Nicole Reimann presented on the above topics at the New Jersey (NJCCA) Chapter – Association of Corporate Counsel (ACC) Annual Conference, on September 23rd, 2011. Schnader’s Carl J. Schaerf, the chair of our Antitrust and Trade Regulation Practice Group, served as a moderator for this conference.
