Patterson Process Equipment Corp. Removed from Mass Tort Litigation

Our Delaware client, Patterson Process Equipment Corporation, was sued in New York State Supreme Court in an asbestos case that involves dozens of defendants. The plaintiff alleged that he was exposed to asbestos while working as a plumber for a company in Albany. His lawyers sued the Firm''s client as a successor-in-interest to the company that originally manufactured the asbestos-containing product (American Hydrotherm Corporation), arguing that Patterson Process had purchased at public auction select product drawings patented by American Hydrotherm, even though this intellectual property was acquired by Patterson more than a decade after the plaintiff''s last exposure to asbestos. The motion for summary judgment on behalf of Patterson Process was granted by the New York State Supreme Court. It took Firm partner Peter Langenus and Associate Matthew Tamasco less than three months to remove our client from this mass tort litigation, saving the client tens of thousands of dollars.
