Schnader Family Law Department Victorious in International Child Custody Case


Mark Momjian and Meredith Brennan of the Family Law Department achieved a victory in a very compelling child custody case before the Delaware County Court of Common Pleas. Mark and Meredith represented a father whose young son was abducted by the child’s mother and taken to Scotland.  The mother, a Scottish national, violated a court order prohibiting her from taking the child out of the country.  When the abduction was discovered, Mark and Meredith filed an emergency application in Delaware County, securing an order granting the father sole legal and physical custody of the child, and declaring Pennsylvania the “place of habitual residence” of the child for purposes of the Hague Convention. Working with the U.S. State Department, along with Scottish counsel in the United Kingdom, the mother was ordered to return to Pennsylvania with the child, who was then placed in the father’s sole custody.  The father is a retired Marine, who has been decorated for valor for his service in Iraq and Afghanistan.  After she returned to the United States, the mother was arrested and charged with two felonies: kidnapping and custodial interference.
