Another Court Holds Daubert Analysis Required When Critical to Class Certification

This Alert focuses on a recent decision by the U.S. District Court for the Middle District of Pennsylvania in a multidistrict price-fixing antitrust case, holding that a Daubert analysis is appropriate and necessary at the class certificate stage when the expert testimony is critical to the determination of class certification. As the Alert explains, the issue regarding whether Daubert applies at the class certification stage is a critical one: the Circuits are split and the Supreme Court has recently granted certiorari on the issue.
