“Back to Basics: Federal Jurisdiction in a Montreal Convention Case”

On January 1, 2015 by Schnader

Schnader attorneys Barry S. Alexander and Julie E. Randolph authored “Back to Basics:¬†Federal Jurisdiction in a Montreal Convention Case” for The Binder, the Aviation Insurance Association’s tri-yearly newsletter. The article discusses how recent United States court decisions have narrowed the scope of general personal jurisdiction, making the defense more viable in Montreal Convention cases, and cautions that not all airline ticket purchases necessarily confer specific personal jurisdiction. The authors conclude that even though some areas of the law remain unsettled, airlines should keep the personal jurisdiction defense in mind when evaluating lawsuits against them.
