Clarifying Media Reports Regarding Maryland Law and Causation in Asbestos Exposure Cases – part 1

It was recently reported in Law360 that Maryland’s highest court broke with established precedent and endorsed the “any exposure” theory of asbestos causation. This conclusion misconstrues the Court’s decision. Maryland continues to endorse “substantial-factor causation.” This Alert addresses the fact that any entity defending asbestos claims in Maryland should continue to consider defenses based on substantial-factor causation.
