Pennsylvania Supreme Court Reaffirms Dunham Rule, Confirms that Marcellus Shale Natural Gas is not a “Mineral”

The Pennsylvania Supreme Court has issued a decision reaffirming that courts should presume that a reservation of “mineral” rights in a private deed does not cover natural gas and oil absent clear proof that the parties intended otherwise.
