“Recent Developments in Aviation Products Liability”

J. Denny Shupe and Steven K. Armstrong co-authored the article “Recent Developments in Aviation Products Liability” for the American Bar Association’s Forum on Air and Space Law 2012 Update Conference in Washington, D.C. on February 17, 2012. The article addresses selected topics of current interest and recent developments in the field of aviation products liability, including: pleading requirements arising out of Iqbal and Twombly; the General Aviation Revitalization Act of 1994 (“GARA”); federal preemption; the government contractor defense, the educational malpractice doctrine and duty to train; the recently enacted Federal Courts Jurisdiction and Venue Clarification Act of 2011; and removal of aviation products liability cases based on federal question jurisdiction.
