Matthew Kelly co-authored (with William Kelly) an article titled “The Trouble with Authenticating Internet Postings and Other E-Evidence,” published in the Winter 2009 edition of Proof, the quarterly newsletter of the American Bar Association’s Trial Evidence Committee. The article discussed the standards that various federal courts, including the Second Circuit, have recently applied to the admissibility of web page postings, chat room transcripts, and similar evidence derived from the internet, and the problems related thereto.
