Third Circuit Provides Guidance on Time for Filing a Notice of Appeal

The Third Circuit recently clarified the timing for a party to file a notice of appeal after a judgment is filed. While usually cut-and-dry, situations occasionally arise where the action that commences the 30-day period for filing a notice of appeal is ambiguous. This Alert discusses a recent Third Circuit opinion in which this ambiguity cost a party the opportunity to appeal and advises on how best to protect a party’s appellate rights.
