Third Circuit Remands Marcellus Shale Case Based on the Class Action Fairness Act’s Local Controversy Exception
On December 6, 2013 by SchnaderIn Jeffrey S. Vodenichar et al. vs. Halcón Energy Properties, et al., the U.S. Court of Appeals for the Third Circuit explained the home state and local controversy exceptions to federal jurisdiction under the Class Action Fairness Act in remanding to the Mercer County Court of Common Pleas a class action arising from Halcón’s rejection of leases for approximately 30,000 acres of land intended for Marcellus Shale drilling operations.
