Wage and Hour Division Unveils Plans to Survey Workers’ Knowledge of Their Classification as Employees or Independent Contractors; May Signal Plan to Reactivate “Right to Know” Rulemaking

The Labor and Employment Practices Group has prepared its latest Alert on plans the U.S. Department of Labor has to continue its assault on classifying workers as independent contractors, and on classifying employees as exempt from overtime eligibility by surveying workers on what they know about their classification and the justification(s) for it, and about their knowledge of their rights. As the Alert explains, the survey is consistent with the Department’s aggressive approach, and appears to be seeking post hoc support for a rule the Department claimed was necessary two years ago.
