On July 1, 2009 by Schnader

Jonathan M. Stern, counsel in Schnader’s Washington, DC office, authored an article titled “Who’s on First? A Plea for Clarity in Drafting Contractual Indemnity Provisions,” published in the July 2009 issue of For the Defense, the monthly magazine of the Defense Research Institute (DRI). Enforcement problems can be prevented through clear language with more detail about the respective rights and obligations of the parties. The article explains the need for detail and clarity in establishing indemnity obligations in contracts and suggests some straightforward means for providing it.
