Give Me Your Tired, Your Poor, Your Huddled Masses ... But Not Your Plaintiffs: Supreme Court Decision Limits General Personal Jurisdiction Over Foreign Defendants

For years, there has been a growing trend of foreign plaintiffs bringing lawsuits in the U.S. even where the lawsuit has a minimal if any connection to the U.S. While the doctrine of forum non conveniens has proven a useful defense, its success has been far from absolute. This Alert explores the Supreme Court's recent decision in Daimler AG v. Bauman, which narrowed the scope of general personal jurisdiction over foreign multinational companies in the U.S. The Court's decision represents a substantial victory for foreign defendants, and eyes no doubt will now turn to watch how lower courts apply the new standard.
