Massachusetts Bans Criminal History Questions from Most Employment Applications

As part of a law enacted over the summer reforming the Criminal Offender Recommendation Information (“CORI”) system, Massachusetts has prohibited most employers in the Commonwealth from requesting information from applicants about their criminal history on an initial written job application. This portion of the new law became effective earlier this month, so employers either actively hiring or expecting to hire in Massachusetts should immediately delete questions about criminal history from initial applications they use in that state and review any employment policies that might be affected. This Alert details changes that employers can expect due to the enactment of the new law.
